Việc tuyên phạt ông Phạm Chí Dũng 15 năm tù và ông Nguyễn Tường Thụy và ông Lê Hữu Minh Tuấn mỗi ông 11 năm tù là một diễn biến tiêu cực. Cả ba đều là thành viên của Hiệp hội Nhà báo Độc lập Việt Nam (IJAVN), một tổ chức xã hội dân sự thúc đẩy tự do ngôn luận, tự do báo chí và tự do lập hội. Các quốc gia phải bảo vệ quyền tự do ngôn luận và tạo ra một môi trường thuận lợi cho các cuộc tranh luận công khai ngay cả khi các ý kiến được bày tỏ trái ngược với những ý kiến mà chính quyền đưa ra. Quyền tự do bảy tỏ quan điểm và biểu đạt – cả trực tuyến và trực tiếp – là yếu tố quan trọng để đảm bảo tính minh bạch, công bằng xã hội, phát triển bền vững và bao trùm cũng như thịnh vượng.
Quyền tự do biểu đạt được đảm bảo bằng Hiến pháp của Việt Nam, Tuyên bố Toàn cầu về Nhân quyền và các công ước quốc tế khác mà Việt Nam tham gia ký kết, bao gồm cả Công ước Quốc tế về các Quyền Chính trị và Dân sự. Hơn nữa, trong khuôn khổ của Đánh giá Định kỳ Phổ quát, Việt Nam đã chấp nhận các khuyến nghị để đảm bảo và dỡ bỏ các hạn chế đối với quyền tự do bày tỏ quan điểm và biểu đạt. Tuy nhiên, việc gia tăng những vụ bắt bớ, bỏ tù và kết án những nhà báo Việt Nam và những nhà bảo vệ nhân quyền lại đi theo hướng ngược lại.
Liên minh châu Âu mong các nhà chức trách Việt Nam trả tự do ngay lập tức cho ông Dũng, ông Thụy và ông Tuấn, cũng như tất cả các nhà báo, blogger và các nhà bảo vệ nhân quyền bị bỏ tù vì đã bày tỏ quan điểm một cách ôn hòa. Liên minh châu Âu sẽ tiếp tục theo dõi và làm việc với các cơ quan chức năng của Việt Nam và tất cả các bên liên quan để cải thiện tình hình nhân quyền ở Việt Nam.

Vietnam: Statement by the Spokesperson on the sentencing of three journalists
The sentencing of Mr. Pham Chi Dung to 15 years in prison, and 11 years each for Mr. Nguyen Tuong Thuy and Mr. Le Huu Minh Tuan, is a negative development. All three are members of the Independent Journalists’ Association of Vietnam (IJAVN), a civil society organization that promotes free speech, press freedom, and freedom of association. States must protect freedom of expression and create a favorable environment for public debate even when the opinions expressed are contrary to those held by the authorities. Freedom of opinion and expression – both online and offline – is vital to ensure transparency, social justice, sustainable and inclusive development, and prosperity.
The right to freedom of expression is guaranteed by the Vietnamese Constitution, the Universal Declaration of Human Rights, and other international conventions, which Vietnam has signed up to, including the International Covenant on Civil and Political Rights. Moreover, in the context of the Universal Periodic Review, Vietnam accepted recommendations to guarantee and lift restrictions on freedom of opinion and expression. However, the increasing number of arrests, imprisonment, and sentencing of Vietnamese journalists and human rights defenders go in the opposite direction.
The European Union expects the Vietnamese authorities to immediately release Mr. Dung, Mr. Thuy, and Mr. Tuan, as well as all journalists, bloggers, and human rights defenders imprisoned for having peacefully expressed their views. The European Union will continue to monitor and work with the Vietnamese authorities and all relevant stakeholders to improve the human rights situation in Vietnam.
